These terms and conditions (“Terms”) apply to the use of the ShinyBright website at www.shinybright.com.au (“Website”), as well as any services provided by ShinyBright, including cleaning services (“Services”). By using the Website or Services, you agree to be bound by these Terms.

1. Website Use

The Website is for your personal and non-commercial use only. You must not use the Website for any illegal or unauthorised purpose, or to transmit or upload any harmful viruses, worms, or malicious code. You must not attempt to gain unauthorised access to any part of the Website, or interfere with or disrupt the operation of the Website.

2. Service Bookings and Payment

By booking Services through the Website (all bookings must be made online), you agree to pay the quoted price for the Services, including any additional fees or charges for extra Services requested. We use a third party booking, scheduling, management and review app called Launch27 (www.launch27.com) and by using our website, booking and related services you agree to their privacy policy you can find at www.launch27.com/privacy-policy and to their terms of service you can find at www.launch27.com/terms-of-service. Please read all of the above documents carefully and do not proceed unless you agree to be bound by all of them.

During the booking process you will be asked for your payment details for your weekly or fortnightly service. We do not offer one off cleans or end of lease cleans or anything other than a weekly or fortnightly clean. You will not be charged until your cleaning service has been delivered.

3. Cancellation and Refund Policy

If you need to cancel a booked Service, you must provide at least 48 hours’ notice. If you fail to provide sufficient notice, you may be charged for your service in full. Due to the regular, bespoke nature of our service (that is, being a weekly or fortnightly service), a staff member is assigned to you and can not be distributed to another client as other clients already have a regular staff member assigned to them. Since our staff members will lose their income for your regular service we charge a $50 cancellation fee that is given to our staff member as compensation for the cancellation. We hope you understand that in providing a premium service we must respect our staff who will always provide you with the best service they can. Providing a token of gratitude in the event of a cancellation goes a long way to building and maintaining a great relationship with them we both benefit from.  Shiny Bright may cancel a Service booking at any time for any reason, in which case you will receive a full refund for that cancelled service.

4. Service Guarantee and Liability

Shiny Bright guarantees that Services will be performed with reasonable care and skill. However, to the maximum extent permitted by law, Shiny Bright is not liable for any loss or damage, whether direct, indirect, consequential, or otherwise, arising from the provision of the Services or any act or omission by Shiny Bright, its employees, or contractors.

5. Intellectual Property

The content and intellectual property on the Website, including but not limited to logos, trademarks, designs, images, text, and software, are the property of Shiny Bright or its licensors. You must not copy, reproduce, modify, distribute, or display any part of the Website without prior written consent from Shiny Bright.

6. Privacy Policy

By using the Website or Services, you agree to the collection, use, and disclosure of personal information in accordance with Shiny Bright’s Privacy Policy, which can be found on the Website.

7. Amendments to Terms and Conditions

Shiny Bright may amend these Terms from time to time by posting an updated version on the Website. By continuing to use the Website or Services, you accept the updated Terms.

8. Anti-Defamation

As a visitor to our website, you agree not to leave any non-perfect, that is, anything other than a perfect, positive review or comment on any review platform, including, but not limited to Google Reviews, Yelp, Facebook Reviews, Better Business Bureau (BBB), ProductReview.com.au, TrueLocal, WOMO, Oneflare, Yellow Pages. As an example, a 5 star Google review is perfect. A 4.9 star Google review is not perfect.

If you have any concerns about our business, including, but not limited to, the products or service we offer, the way we offer them, where we offer them, any content in our marketing on and off our website, our prices, our values or perceived values, our terms and conditions, the consequences of breaching our terms and conditions, or any other matter, which leads you to want to leave a non-perfect review or comment on any platform, you agree not to leave any non perfect review anywhere and instead, respectfully contact us at terms@shinybright.com.au to discuss your concern/s and give us the decency and opportunity to respond to you. In good faith, we will attempt to address your concern/s. In many instances, we will be able to address them satisfactory to your expectation. In some cases, however, you many still feel like our response is not in line with your expectations. We will respond honesty and promptly and we ask that you respect our decision to operate our business in the way that we choose to. We consider you leaving any non perfect reviews anywhere as defamation and you agree to be held to this.

If you publish a non-perfect review or comment, that is, anything other than a perfect, positive review or comment on any review platform, or any comments perceived by us to be negative or defamatory in any way whatsoever, including, but not limited to, referencing this clause, you agree to immediately pay us AUD $25,000 per review or comment you have left upon request. You agree to cover all and any legal costs for us to pursue you. You agree to enter into the costs agreement provided to you by our legal representative and to pay our legal costs directly to our legal representative as and when they fall due and as permitted by law. You agree to indemnify us of any costs whatsoever. You authorise us, or our legal representative, to place a caveat over any real property you have in your name, anywhere in the world, as allowed by law. You acknowledge we may sell this debt to a third party, including, but not limited to, a debt collection agency. If we do this, we no longer have any control over the outcome and removing the review or comments will not cease the legal action against you. Screen shots of your review and or comments is satisfactory evidence you published them. You authorise our legal repressive and or law enforcement authorities to obtain any information they require through third party experts including, but not limited to, providing your devices for examination by experts to retrieve information relating to the your review/s or comments.

We will always act in good faith with fairness. We expect others to act in good faith with us.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these Terms or the use of the Website or Services will be subject to the exclusive jurisdiction of the courts of Victoria.
